Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") govern your use of the IntSeaJobs mobile application (Android package: com.portingen.intseajobs), the IntSeaJobs web platform at intseajobs.com, and related services (collectively, "the Service") provided by Portingen Technologies LLC ("Portingen", "we", "us", or "our").

By registering for an account or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

Note for owner: These Terms are a working draft prepared for initial Google Play compliance. They should be reviewed and finalised by legal counsel before formal release.

2. Purpose of the service

IntSeaJobs is a maritime employment platform that connects seafarers with employers and recruitment companies in the maritime industry. It provides tools for managing seafarer CVs, applying to job vacancies, managing company fleet and crew requirements, and related maritime operational workflows.

Portingen Technologies LLC is a technology platform provider. We are not an employment agency and do not act as an employer, recruiter, or intermediary in any employment relationship. We do not guarantee that using the Service will result in employment, hiring, or any specific business outcome.

3. Account registration and security

• You must provide accurate, complete, and current information when registering.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You must notify us immediately at support@intseajobs.com if you suspect unauthorised access to your account.
• Accounts are personal and may not be shared or transferred to another person without our written consent.
• You must be at least 16 years old (or the minimum age in your jurisdiction) to register.

4. User responsibility for CV and profile accuracy

You are solely responsible for the accuracy, completeness, and truthfulness of all information you provide in your profile, CV, documents, certificates, and any other content you upload or submit.

• Portingen Technologies LLC does not verify the authenticity of documents, certificates, licences, or qualifications you upload.
• Providing false, misleading, or fraudulent information is strictly prohibited and may result in immediate account termination and referral to relevant authorities.
• If your qualifications, certifications, or personal details change, you are responsible for updating your profile promptly.
• Employers and recruiters rely on the accuracy of your profile. You accept full legal responsibility for inaccuracies, omissions, or misrepresentations.

5. Document authenticity

Any certificates, licences, medical records, passports, or other maritime compliance documents you upload must be authentic, valid, and belong to you. Uploading forged or fraudulent documents is a violation of these Terms and may constitute a criminal offence. Portingen Technologies LLC reserves the right to remove suspicious documents and to cooperate with maritime authorities where required by law.

6. Employer/seafarer interactions

The Service facilitates connections between seafarers and employers. Portingen Technologies LLC is not a party to any agreement, employment contract, or arrangement entered into between seafarers and employers. Any disputes arising from employment or recruitment relationships must be resolved directly between the parties involved.

Employers are responsible for complying with all applicable employment laws, maritime regulations, and data protection obligations when accessing seafarer profiles.

7. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws
• Scrape, crawl, or systematically extract data from the Service
• Attempt to gain unauthorised access to any part of the Service or other users' accounts
• Upload malware, viruses, or any harmful code
• Harass, impersonate, or harm other users
• Post false, misleading, or fraudulent job vacancies or profiles
• Use the Service to send unsolicited communications or spam
• Interfere with the integrity or performance of the Service
• Reverse-engineer or attempt to extract source code from the application

Violations may result in immediate suspension or termination of your account, with or without prior notice.

8. Intellectual property

The IntSeaJobs name, logo, application design, and content produced by us are the intellectual property of Portingen Technologies LLC. You may not copy, reproduce, distribute, or create derivative works from our content without written permission, except as expressly permitted in these Terms or by applicable law.

Content you upload (your CV, documents, photos) remains yours. By uploading it, you grant Portingen Technologies LLC a limited licence to store, display, and transmit it as necessary to operate the Service on your behalf.

9. No guarantee of employment

Portingen Technologies LLC does not guarantee that using the Service will result in any employment offer, hiring decision, crew placement, or business transaction. The platform is a tool for facilitating connections; outcomes depend entirely on the decisions of independent seafarers and employers.

10. Service availability and changes

We aim to maintain reliable access to the Service, but we do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will aim to provide reasonable notice for material changes where possible.

11. Account termination

You may close your account at any time by submitting an account deletion request through the app (Account tab → Account & Data → Request account deletion) or by contacting us. See our Account Deletion page for details.

We reserve the right to suspend or terminate your account if you violate these Terms, if your account is inactive for an extended period, or where we are required to do so by applicable law.

12. Limitation of liability

To the maximum extent permitted by applicable law, Portingen Technologies LLC and its directors, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of employment opportunity, loss of income, or data loss.

Our total aggregate liability to you for any claims arising under these Terms will not exceed the greater of (a) the amounts you have paid us in the twelve months preceding the claim, or (b) USD 100, except where prohibited by law.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

14. Governing law

These Terms are governed by the laws applicable to Portingen Technologies LLC's place of establishment. Any disputes arising from these Terms should first be addressed by contacting us at legal@intseajobs.com.

15. Changes to these terms

We may update these Terms from time to time. We will notify registered users of material changes by email or via an in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
